ART DE LEX lawyers have defended the interests of Globaltrans in the Arbitration Court of the Moscow District

On 29 December 2015, the Arbitration Court of the Moscow District rejected the appeal of FAS Russia and confirmed the legality and validity of the conclusions of the Ninth Arbitration Appeals Court and the Moscow Arbitration Court to invalidate the decisions of the FAS Russia to impose administrative fines in the amount of RUB 2.2 billion on various companies. In 2011, FAS Russia had accused rolling-stock operators, Russian Railways, and the Administration of the Kemerovo region of conspiring to reduce competition.

The ART DE LEX law firm represented the interests of New Forwarding Company and GTI Management (previously known as Ferrotrans), which are parts of the Globaltrans Group. The lawyers managed to eliminate the court-imposed penalties on the group of companies that amounted to more than RUB 130.

Among the operators that FAS Russia had accused of wrongdoing were the following: New Forwarding Company, LLC; Ferrotrans, OAO; Federal Freight, LLC; Independent Transport Company, JSC; Freight One PJSC; NefteTransServis ZAO; TK Novotrans, LLC; SibUgleMetTrans, LLC; RG-Trans, LLC; ZapSib-TransServis, LLC; OJSC SUEK; Mechel-Trans, LLC; TransGroup LLC; RVD-Servis LLC; Evrosib SPb-Transportation Systems; and Firm Tranzit-Plus LLC.

A partner and the head of the ART DE LEX Competition Practice, Yaroslav Kulik, and the head of the Competition Practice Group at ART DE LEX, Kirill Dozmarov, represented the client’s interests in arbitration courts.
