Dmitry Magonya takes part in general meeting of National Association of Procurement Institutes (NAPI)

On 20 March 2012, a general meeting of the National Association of Procurement Institutions (“NAPI”) entitled “NAPI’s first year in the industry: a review and prospects”, where Dmitry Magonya, Managing Partner of ART DE LEX, took part as chairman of the Committee for Law and Legislative Drafting (“CLLD”) and reported on the results of the work of the NAPI committees for 2012.

According to Mr Magonya, “no-one any longer has a doubt that the state procurement system requires drastic rethinking; and not just some formal overhaul, but, rather, a full reworking from scratch,” particularly because, “the creation of NAPI in 2012 was undoubtedly one of major events in public procurement”.

The main activity of CLLD is to develop and improve legislation in the area of public procurement. The established goal is the expression of the more general goals of creating NAPI.

Mr Magonya also spoke about an interesting initiative to set up a mediation group within NAPI. “As a professional law firm, we also provide legal support to customers and suppliers in resolving disputes. We propose creating a meditation and out-of-court settlement group within NAPI for customers and suppliers. Our legal qualifications will allow us to assist them in avoiding excessive costs for legal disputes and losses through mediation”, believes Mr Magonya.

The following results of NAPI’s activity for the year are worth noting:

  • making proposals and suggesting addendums to the Federal law “On the Federal Contract System”;
  • assessing the regulation and anticorruption evaluation of draft legal acts, and commenting on and developing proposals for amendments and addendums;
  • preparing drafts of regulatory acts;
  • participating in public, parliamentary, departmental and other hearings, conferences and events; and
  • collaborating with the Authorised Body of the President of the Russian Federation for the Protection of Entrepreneurial Rights.
