Law «On Contract System» entered into force on 1 January 2014

The Federal Law of 05.04.2013 №44-FZ “On the Contract System for State and Municipal Procurement of Goods, Works and Services” became effective on 1 January 2014. The Law on Contract system replaced the Federal Law of 21.07.2005 №94-FZ “On Placement of Orders to Supply Goods, Carry out Works and Render Services for Meeting State and Municipal Needs” by widening the range of covered issues regarding the placement of state orders and governing all stages of procurement from its planning to execution.    

ART DE LEX lawyers took an active role in the enactment of the Law on Contract system, provided the analysis of the business sector, participated in the expertise platform respecting the reform of state procurement system and drafted the proposals for modification and alteration of the draft law in all stages of its development.

ART DE LEX professionals devoted much attention to forms of public control in relation to state procurements, principles of efficiency and productivity in procurements, issues concerning the regulation of the electronic placement of orders along with the necessity to extend the scope of such regulation to all supplier selection procedures and issues regarding the operation and allocation of electronic tenders. Though the current Law on Contract system provides for only one form of electronic procurements (i.e. electronic auction), the amendments introducing the competitive tenders by electronic means have already been prepared.
