Yaroslav Kulik delivered a report at the round table “Procurement activities of electric grid companies” within the framework of the annual Rugrids-electro international power forum

From 20 to 23 October, in Moscow, Rossetti, with the participation of the Ministry of Energy of the Russian Federation, presented the Rugrids-electro international electric power forum on “Russian Networks. New Opportunities.”

During the forum, which included a business program with a great deal of discussion and interactive activities, an open roundtable discussion on “Procurement activities of electric grid companies” took place on 21 October 2015.

Yaroslav Kulik, a partner and the head of the competition practice of ART DE LEX, participated in the discussion. He spoke about the latest proposed changes to Law 223-FL and its related legal risks and opportunities for both customers and suppliers.

The dialogue was an informational interaction among all the participants in the procurement process: customers, suppliers, regulatory authorities, and interested non-governmental organizations. The discussion paid particular attention to the changes in the legislative regulations regarding procurement, with respect to the largest companies in the field and to the practical application of the Regulation on Procurement Activities to Rossetti, its subsidiaries, and its affiliates.

The round table addressed the following topics:

1. Normative regulations regarding procurement, legal issues, and trends in legislation. The objectives of the state and the opportunities for businesses. The Federal Corporation for the Development of Small and Medium Enterprises.

2. Small and medium enterprises in the procurement process of group companies. The first results of the implementation of the Resolution of the Government of the Russian Federation, No. 1352, of 11 December 2014. The balance between the economic and social burden for customers. The problem of the lack of awareness of participants about existing support mechanisms for SMEs. What can and should a customer do? What can and should suppliers do?

3. The procurement of innovative and high-tech products (the draft decree of the Government of the Russian Federation and the potential problems regarding its implementation). How to communicate with customers and manufacturers about functional innovation.

4. Import substitution. The conflict between the task and the lack of real mechanisms for its implementation within the context of corporate procurement–topics related to Law 223-FL.

5. E-court. What creates obstacles and for whom? Do we need five sites, or should we keep a competitive market trading platform in the mandatory stringent requirements for members?

6. Prospects for the development of procurement–Law 44-FL. Pros and cons.

The Rugrids-electro International Forum is aimed at addressing the internal and external challenges facing the Russian power industry, adopting solutions for the most important aspects regarding the functioning of the power grid complex, as well as forecasting the future prospects and conditions of the industry.

The main objective of the Forum 2015 was to demonstrate the capacity of Russia’s power industry for a qualitative leap in the conditions needed to increase efficiency, especially in the context of a rapidly changing global economy.

More than 5,000 representatives and leaders of federal and regional authorities, public associations, research organizations, large network and generating companies, equipment manufacturers, technology providers, developers, as well as Russian and foreign experts in the field of electricity attended more than 50 events of the business program along with the scientific and technical exhibition.
