ART DE LEX defended the interests of Globaltrans and succeeded in overturning the decision of the FAS Russia against the administration of the Kemerovo Region, Russian Railways, and 16 rail operators

 On 9 June 2015, the Arbitration Court of Moscow, during proceedings that Globaltrans, other operators, and Russian Railways instituted, overturned the decision of the Federal Antimonopoly Service (FAS) that had resulted in fines for operators, the Russian Railways, and the administration of the Kemerovo Region for conspiracy charges that date to 2011.

In September 2013, FAS Russia found that administration of the Kemerovo Region, Russian Railways, and 16 operators were guilty of violating Article 16 of the Law on Protection of Competition. The FAS claimed that they had concluded anticompetitive agreements for the provisioning of wagons to export coal from the Kuzbass Region. According to the FAS, the actions of the defendants reduced the number of operators in the Kemerovo Region from 230 to 16.

The operators the FAS accused of curtailing competition included the following: Federal Freight Company PLC; Independent Transport Company LLC,  First Freight Company PLC, NefteTransServis CJSC; Novotrans LLC; SibUgleMetTrans LLC; RG-Trans LLC; ZapSib-TransServis LLC; SUEK PLC; New Forwarding Company PLC; Mechel-Trans LLC; TransGroup LLC; RVD-Servis LLC; Eurosib-Transportation Systems CJSC; Ferrotrans LLC; and Tranzit - Plus LLC.

Based on the FAS decision of early December 2013, all the defendants faced fines that totaled more than RUB 2 billion.

Yaroslav Kulik, a partner at ART DE LEX, and Kirill Dozmarov, a lawyer in the Competition Practice of ART DE LEX, represented the interests of New Forwarding Company and Ferrotrans of the holding company Globaltrans Investments PLC. In their opinion, the court’s overturning the FAS decision is logical and the result of the efforts of the lawyers in the case, which lasted in the court of first instance for more than a year and a half. The amount of material comprised 200 volumes. Attorneys from the legal firms Goltsblat BLP, Pepelayev Group, and UST represented the interests of other operators.
