Representatives of ART DE LEX took part in the annual All-Russian seminar on tariff regulation in Yalta

Kirill Dozmarov and Tatiana Basova took part in the annual All-Russian seminar on tariff regulation in 2018 and the tasks of the state regulatory authorities for 2019. Approximately 700 delegates attended the function. The topics for discussion at the All-Russian seminar were the implementation of tariff regulation in the Russian Federation, both on the federal and citizen level, as well as the improvement of legislation in the state regulation of tariffs. The seminar included both strategic sessions and thematic roundtables.

At the meeting of the working group on tariff disagreements and pretrial disputes in price (tariff) setting, Kirill Dozmarov noted the importance of systematizing procedures for handling tariff cases with the Federal Antimonopoly Service of Russia. In his presentation, Mr. Dozmarov also stressed the importance of securing the procedural rights of business entities in tariff cases. “Despite all its imperfection and the need to improve certain provisions, the new law on the basis of state regulation of prices (tariffs) will be an excellent framework, in the future, for the formation of a uniform and transparent practice of law enforcement.”

Tatyana Basova, speaking at the meeting of the working group on long-term tariff regulation of the electricity grid complex, stressed the need to assess the financial implications on regulated activities resulting from the introduction of economic methods of state regulation. “In our expert activity, we face the analysis of a huge array of financial statements. Often, the results of such analysis show a sad and paradoxical picture: the expenses of regulated companies exceed their income, which indicates the unprofitability of regulated activities. The reason for this is the lack of a full-fledged financial analysis and forecasting of regulated activities. A second important legal gap is the lack of a corporate pricing culture within the companies themselves. In our opinion, regulated companies should form the methodological basis of both the tariff policy and the transparency of regulated activity during the development of internal corporate policies.”
