The Supreme Court condoned a failure to comply with a court decision

The Prosecutor’s Office through court action obliged a trade union federation to modify its articles of association. In compliance with this decision, bailiffs were forcing the association to make the relevant changes to the constituent document within five days, although the law provides several months for this. Predictably, the obligor was unable to meet the requirements of the Federal Bailiff Service and got a fine from it. To cancel the fine, the case had to reach the Supreme Court.

The corporate legislation does not make it possible to modify articles of associations in five days,  emphasizes Yulia Shilova, Head of Reconstruction and Bankruptcy at the ART DE LEX law firm. However, this did not stop the Novosibirsk bailiffs. They made such claims to the Federation of Trade Unions of Novosibirsk Region (FPNO) that brings together all organisations of this kind within the region and is listed as a member of the Federation of Independent Trade Unions of Russia (FNPR).
