ART DE LEX lawyers successfully petition Moscow arm of FAS of Russia for cease and desist against Feretti Rus

The Moscow office of Federal Antimonopoly Service of Russia issued a cease and desist order to OOO Feretti Rus under art. 14.1 of the Competition Act as regards making false, inaccurate and distorted statements in respect of OOO Ramensky Confectionery Factory and the Baker House sponge pies.

Feretti Rus and Ramensky Confectionery Factory are major manufacturers of sponge cakes in Russia, marketing their products under the brands of Faretti and Baker House respectively.

The Moscow office of FAS of Russia established that Feretti Rus sent letters to a number of economic agents in 2015-2016, demanding that they stop buying, promoting, marketing and otherwise placing into the stream of commerce Ramensky Confectionery Factory's products such as Baker House sponge cakes, and threatening them with legal action unless they comply. Yet the allegations made in the letters were false.

ART DE LEX provided legal services and representation for Ramensky Confectionery Factory before the Moscow arm of FAS of Russia. The petition and materials sent to the antitrust authority resulted in Feretti Rus being issued an antitrust cease and desist order. In the event of failure to comply with the order within the specified time limit, the Moscow office of FAS of Russia will take legal action against Feretti Rus for breach of competition law.
