Artur Zurabian | A commentary for Advokatskaya Gazeta: The Scientific Advisory Board of the Moscow District Arbitration Court offers recommendations for courts on the nuances of arbitration proceedings

The Scientific Advisory Board of the Moscow District Arbitration Court has offered recommendations for courts on the nuances of arbitration proceedings.

The Presidium of the Moscow District Arbitration Court has approved protocol resolution No. 23, which contains six recommendations of the Scientific Advisory Board of the Moscow District Arbitration Court.

Artur Zurabian, an advocate and head of ART DE LEX Dispute Resolution and International Arbitration Practices, says that the issue of admissibility of several counterclaims in one and the same case is interesting. «I think, if you ask practicing lawyers whether a second counterclaim is admissible after the first one has been filed, the answer would be negative in 9 out of 10 cases. And the logic of such negative answers is clear. At the same time the Presidium of the Moscow District Arbitration Court has considered this option acceptable, making a reservation that the plaintiff acts in such claims in good faith,» he notes.
