Marat Samarsky | comments for the Vedomosti: Gazprom goes to arbitration to make Poland pay extra for gas starting from 2017

14 January, Gazprom filed a claim to the Arbitration Institute of the Stokholm Chamber of Commerce (the Stokholm Arbitration Court) for retroactive revision of price conditions of the contract for gas supplies to the PGNiG Polish state-owned company, as both companies reported. “Taking into consideration the fact that commercial negotiations for reviewal of the price in compliance with the Gazprom Export requirements failed to result in reaching an agreement, the Russian company, in accordance with the provisions of the contract, has submitted these disputes to an arbitration tribunal for resolution”, states the Gazprom Export (Gazprom export entity) release. PGNiG specified that the Russian company’s claim is applicable to the contract provisions since 2017. 

Attorney of International Economic Compliance of ART DE LEX Marat Samarsky added that such claims have become frequent since the 2008 recession, when parties strived to achieve reconsideration of long-term pricing conditions in the situation of unstable commodity markets.
