Dmitry Magonya | comments for Pravo.ru: Google will pay the largest penalty in practice, if it does not unblock Tsargrad

The company will have to restore the TV channel YouTube account closed for the reason of sanctions or pay a billion by March. This decision was made today by the 9th Commercial Court of Appeal.

The 9th CCA upheld the decision of the Commercial Court of Moscow that obliged Google to unblock Tsargrad  and return monetization of advertising. The judges ordered, starting from 23 December, for a failure to fulfil the court decision to charge Google a penalty in the amount of 100,000 roubles a day. The sanctions will be doubled every week.

According to Dmitry Magonya, Managing Partner of ART DE LEX, who represented the interests of Tsargrad, the court established the largest astreinte (court penalty) in the Russian litigation practice.

«If the Tsargrad account and YouTube channel are not reactivated, Google will be charged a progressive astreinte that by March 2022 will reach the limit amount of one billion roubles. And should the company persist in its failure to fulfil the court decision after September 2022, the astreinte shall be charged without limitation of the maximum amount», — said Magonya.
