Anastasia Vasilenko | comment for Vedomosti: The court returned Nornikel's railroad to the state

The Arbitration Court of Krasnoyarsk region ruled to seize 11 objects of Norilsk Railroad in Taimyr from Nornickel in favor of the state. This was announced by the company on April 12.

Anastasia Vasilenko, Head of Dispute Resolution and International Arbitration Practices at ART DE LEX, reminds that in July 2021 the court satisfied a similar claim by the West Siberian transport prosecutor's office to withdraw the river moorings from Nornikel.

The limitation period for the case has actually expired (it cannot exceed 10 years for entities other than parties of the transaction), the lawyers say. However, according to Zharov, the court did not take this into account because otherwise the refusal to consider the claim would actually mean legalizing an illegal transaction.
