Yulia Shilova | comments for the Kommersant: Owners and heads of bankrupts will be able to personally dispute with their creditors

The Constitutional Court (CC) allowed persons controlling debtors (PCD) to challenge creditors’ claims included in the register. Heads and owners of companies shall have such right as long as they are brought to subsidiary liability, which will enable them to have an impact on the debt amount stated in the register, which determines the extent of liability. 

This is in line with the position of the Supreme Court, which states that persons brought to subsidiary liability have to be «full-fledged parties to the bankruptcy case» and should be able to have a direct impact on the amount of creditors’ claims, adds Yulia Shilova, Head of Bankruptcy at ART DE LEX.
