What risks Germany runs in case of a refusal to certify North Stream – 2

Germany will not pay any compensation to participants of the North Stream – 2 project, if the country’s Federal Network Agency (Bundesnetzagentur) makes a decision on non-conformity of this pipeline to the requirements of the European Union and Germany. This information was provided by Minister of Economy of Germany Vice Chancellor Robert Habeck in his interview to Spiegel 21 January. 

Both Russian and German parties have repeatedly emphasized that North Stream – 2 is exclusively a commercial project, reminds ART DE LEX attorney Marat Samarsky. In his opinion, freezing of the project may cause «a wide variety of trials, up to investment arbitration (a trial between an investor and the state that is the investment recipient – Vedomosti) and even up to the WTO court».
