Pravo.ru quoted Alexander Petrov in “The Supreme Court defended a client from the bankruptcy of a contractor”

 Pravo.ru quoted Alexander Petrov, attorney at law at ART DE LEX, on the decision of the Supreme Court that gave customers additional protections when contractors file for bankruptcy.

A customer pointed out errors in a construction company’s work. The contractor admitted the mistakes, but bankruptcy prevented the contractor from making the necessary repairs. The client decided not to pay for that portion of the work and to deduct the expenses for correcting the shortcomings from the first payment to the contractor. In court, the counterparty disagreed and demanded the entire amount. Three court decisions sided with the contractor, pointing out that offsetting the claims violated the interests of the creditors in the bankruptcy case. In its ruling, the Supreme Court reversed those decisions.
